Terms & Conditions

1. Acceptance of Terms

By downloading, installing, or using the Indian Valley mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App. We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

The App allows you to browse our menu, place food orders for collection or delivery, participate in our loyalty rewards programme, and receive notifications about promotions and offers. The App is operated by Indian Valley ("we", "our", or "us").

3. Account Registration

  • You must be at least 13 years of age to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate, current, and complete information during registration and to update your information as necessary.
  • We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or in violation of these Terms.

4. Orders and Payment

4.1 Placing Orders

By placing an order through the App, you are making an offer to purchase the selected items. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, stock unavailability, or suspected fraudulent activity.

4.2 Pricing

All prices displayed in the App are in British Pounds (£) and include VAT where applicable. Prices are subject to change without prior notice. The price charged will be the price displayed at the time of order placement.

4.3 Payment

Payment is processed securely through our third-party payment provider at the time of order placement. We accept major credit and debit cards. By providing payment information, you represent that you are authorised to use the payment method.

4.4 Refunds and Cancellations

Once an order has been accepted and preparation has begun, it cannot be cancelled. If you experience an issue with your order (e.g. missing or incorrect items), please contact us within 24 hours of receiving your order. Refunds are issued at our discretion and will be processed to the original payment method within 5–10 business days.

5. Loyalty and Rewards Programme

  • Points are earned on eligible orders placed through the App.
  • Points have no cash value and cannot be transferred, sold, or exchanged for cash.
  • We reserve the right to modify, suspend, or terminate the rewards programme at any time, with or without notice.
  • Accumulated points may expire after 12 months of account inactivity.
  • Any abuse, fraud, or manipulation of the programme may result in forfeiture of points and account suspension.

6. Delivery

Delivery is available within our designated delivery area. Estimated delivery times are provided as a guide and are not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, including traffic, weather, or high demand. A minimum order value may apply for delivery orders.

7. Allergen and Dietary Information

We endeavour to provide accurate allergen and dietary information within the App. However, our food is prepared in kitchens where allergens are present, and cross-contamination may occur. If you have a food allergy or dietary requirement, please contact us directly before placing your order. We do not accept liability for any adverse reactions resulting from the consumption of our food where allergen information has been provided.

8. User Conduct

When using the App, you agree not to:

  • Use the App for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorised access to any part of the App, other accounts, or our systems.
  • Interfere with or disrupt the operation of the App.
  • Submit false, misleading, or abusive information.
  • Use automated tools, bots, or scripts to interact with the App.
  • Reproduce, distribute, or create derivative works from any content within the App without our written permission.

9. Intellectual Property

All content in the App — including but not limited to text, graphics, logos, images, icons, menu descriptions, and software — is the property of Indian Valley or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, or distribute any content from the App without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.
  • In no event shall Indian Valley be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
  • Our total liability to you for any claim arising from your use of the App shall not exceed the total amount you have paid to us through the App in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Indian Valley, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your breach of these Terms, or your violation of any rights of a third party.

12. Third-Party Services

The App may contain links to or integrations with third-party services (e.g. payment processors, map providers). We are not responsible for the content, policies, or practices of any third-party services. Your use of such services is governed by their respective terms and conditions.

13. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately. Any accumulated loyalty points may be forfeited upon account termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
